Q: The 13th National People’s Congress’ fourth session will be held in March this year. It will review the outline draft for the 14th five-year plan. We have noticed that in the previous outline draft’s “pooling wisdom” section, the masses’ suggestions were directly absorbed into the draft. We believe there are many such cases. Are there any that impressed you deeply?

A: Of course there are. In my legislative work which I have been doing for almost 30 years, there are some cases that impressed me very deeply. The masses’ opinions concerning legislation are reflected in legislative organs’ channels without any impediment. The masses’ opinions are accepted and absorbed into the legislative drafts. That happens frequently. It’s something very normal.

臧铁伟:当然有。我从事立法工作将近30年,有几个事例让我印象非常深刻。普通民众对于立法的意见,反映到立法工作机关的渠道是非常畅通的;普通民众的意见被采纳和吸收到法律草案中,也是经常发生、非常正常的一个事情。

There are mainly two channels to which the masses reflect their opinions. The first one is that drafts are publicly addressed to society to seek input. The first legislation the public’s input was sought was for the constitutional draft in 1954. At that time, the scale of that request for society’s input was very big, and it managed to really orderly let everyone from the peasants in rural areas to the workers in the factories and workshops hear the legislative draft. Since then, the seeking of the entire society’s input has gone through a process of sixty years. It should be said that this is an important way for the masses to participate in legislation.

民众向立法机关反映意见,主要有两个渠道。第一个渠道,法律草案公开向社会征求意见。中国最早一部公开向社会征求意见的法律是1954年的宪法草案,当时向社会征求意见的规模非常大,真真正正做到了从田间地头的农民到工厂车间的工人都能听到这部法律草案。从那时起到现在,法律草案征求全社会意见已经经历了60多年的历程。应当说这是人民群众参与立法的一个重要途径。

For example, as for the civil code which is just being put into practice, in the process of its compilation, has sought opinions from the entire society ten times, with more than one million articles, all of which have been sorted out and studied by the legislative organs’ staff.

比如说刚刚施行的民法典,它在编纂的过程中,先后十次向全社会公开征求意见,有100多万条,每一条意见立法机关的工作人员都进行了梳理和研究。

The second main way goes through the legislative working committee’s contact point. In 2015 and 2020, the legislative working committee has thoroughly implemented the spirit of secretary general Xi Jinping’s instructions and the spirit of the central committee’s fourth plenary session, has established ten legislative contact points nationwide twice, nine of which were grassroot legislative contact points, and one of which was for universities. This truly extends the “eyes” and “ears” of legislative work directly to the rural areas and the factories and workshops, schools, communities [neighborhoods], so that we can directly listen to and gather opinions from the grassroot levels’ front line units and the cadres’ and masses’ opinions about the legislative draft.

第二个主要的途径,是通过法工委的立法联系点。法工委在2015年和2020年,贯彻落实习近平总书记指示精神和党的十八届四中全会精神,先后两次在全国范围内建立了十个立法联系点,九个是基层立法联系点、一个是高校。它确实可以让立法工作机构的“眼睛”和“耳朵”直接延伸到田间地头、工厂车间、学校、社区,能直接听取基层一线的单位和干部群众对法律草案的意见。

Over the past five years to date, we have received more than 4,000 opinions concerning more than 80 legislative drafts and legislative plans, by seeking opinions through the grassroots legislative contact points. Among these, many have been adopted into legislative drafts. It should be said that this has been very helpful to improve the quality of legislation.

迄今5年多来,我们先后就80多部法律草案和立法计划,向基层立法联系点征求意见,收到了4000多条意见,其中很多都在法律草案中予以采纳。应当说对于提高立法的质量非常有帮助。

When the Law on the Protection of Minors (revision draft) was given to the legislative contact points to seek opinions, a group of students from a middle school belonging to the East China University of Political Science and Law put forward many amendment proposals to the Law on the Protection of Minors (revision draft) to Hongqiao legislative contact point, including the issue of extracurricular tuition classes, the issue of teachers authority to discipline, how to prevent minors to get deeply addicted to the internet, and the issue of domestic violence.

在2020年未成年人保护法(修订)向立法联系点征求意见的时候,上海华东政法大学附属中学的一群中学生,向虹桥立法联系点提出了许多对未成年人保护法(修订)草案的修改意见,包括课外补习班的问题、教师惩戒权的问题、如何预防青少年沉迷网络的问题、家庭暴力的问题。

After the opinions put forward by these students had been reflected to the Hongqiao legislative contact point working organs, we researched the articles one by one and adopted some into the final legislative drafts. With regards to this, the legislative working committee especially sent a thank-you letter to the East China University of Political Science and Law’s middle school, thanking them for their participation and support in the legislative work.

这些学生提出的意见经过虹桥立法联系点反馈到立法工作机构之后,我们逐条进行了研究,有一些采纳到了最终通过的法律案中。为此,法制工作委员会还特意给华东附中去了一封感谢信,感谢他们对立法工作的参与和支持。

Apart from these two major channels, there are still many other ways. Citizens may write letters, faxes, make a phonecall, and some expert scholars even give their opinions right at the legislative organs. All these channels can be used without impediment.

除了这两种主要的途径之外,还有许多的途径,公民可以通过比如写信、来传真、打电话,甚至有些专家学者当面到立法机关反映意见,这些渠道都是畅通的。

I can give you another example here. A letter without characters on it. There was one concerning the property law draft without any characters. When this letter was opened by our staff, there were no characters, only numerous densely packed dots. Afterwards, everyone guessed that this was probably a letter using Braille. So they took the letter without characters to the China Disabled Persons’ Federation to ask their help. The China Disabled Persons’ Federation also supported us very much, organizing several Braille experts to translate it on the same day, and it was indeed a Braille letter with an opinion concerning the legislative draft. We also carried out research of this opinion. Later, we heard that this had been someone who suffered from impaired vision in Shandong who wrote this letter in Braille.

这里我还可以再举一个例子——一封没有字的信。群众关于法律草案(物权法草案)提出的意见是一封没有字的信。这封信到了立法机关之后,我们的工作人员拆开一看,没有一个字,只有密密麻麻的针眼。后来大家猜测说这很有可能是一封用盲文写成的信,我们的同事就专门拿着这封没有一个字的信到中国残联求助。中国残联也对我们非常支持,组织了几位盲文专家当天就翻译出来了,确实是用盲文对法律草案提出的意见。我们对每条意见又进行了研究和梳理。后来了解到是山东的一位视力障碍患者,用盲文给立法工作机构写的这封信。

Our students and our patients can all freely express their opinion concerning legislative work and legislative drafts, and every article of their opinion must be conscientiously researched and sorted out by our staff. It can be clearly seen that ordinary masses’ rights to participate in legislative work is fully guaranteed.

我们的学生、我们的患者都可以自由表达他们对立法工作、对法律草案的意见,而且每一条意见我们工作人员必定是认真地研究和梳理过的。可见,普通民众参与立法工作的权利是得到充分保障的。

Q: We have noticed that in recent years, the US Senate and House of Representatives have often insisted on launching so-called legislative drafts despite the Chinese side’s warnings, cruelly interfering in China’s internal affairs. You and the National People’s Congress foreign affairs committee spokesperson have published statements many times concerning these matters, expressing strong opposition. May I ask, will our legislative organs also take reciprocal and efficient measures to this, to contain this kind of behavior?

中新社记者:我们注意到,近些年,美国国会参众两院经常不顾中方警告,执意出台所谓法案,从法律的角度粗暴干涉中国内政,您和全国人大外事委员会发言人也多次就此发表谈话,表示强烈反对。请问未来,我们的立法机关是否也会有对等的有效措施,对此类行为进行反制?

A: In recent years, the two American chambers, the US Senate and Congress, have launched many anti-China motions, cruelly interfering in China’s internal affairs, especially on last year’s December 8, when US Congress, because of its opposition against the National People’s Congress’ Standing Commission’s adoption of the Hong Kong national security law and its decision on Hong Kong SAR Legislative Council qualifications issue, surprisingly adopted so-called sanctions against the leaders of China’s National People’s Congress. This is an undisguised and despicable behavior, to use the Hong Kong issue to interfere with China’s internal affairs. The National People’s Congress Standing Commission spokesperson also issued a statement on December 9, strongly condemning this, and expressing firm opposition.

臧铁伟:近年来美国参众两院出台了多项反华议案,粗暴干涉中国内政,尤其是去年的12月8日,美国国会因为反对中国全国人大及其常委会通过的香港国安法和关于香港特别行政区立法会议员资格问题的决定,竟然针对中国全国人大常委会领导作出所谓的制裁,这是公然借香港问题干涉中国内政的卑劣行径。全国人大常委会发言人也于12月9日发表了谈话,对此予以强烈谴责,表示坚决反对。

We have been consistent in opposing foreign and off-borders forces interfering with China’s internal affairs by whatever means, and we will, just as we have in the past, resolutely fulfill our rightful duties, protect national security, sovereignty, and development interests. Of course, we will also watch the situation and take reciprocal countermeasures. As has been seen, given that the American side has used Hong Kong’s affairs to cruelly interfere with China’s internal affairs and to harm China’s core interests, we have decided to take reciprocal countermeasures against US State Department officials, members of Congress and related NGO people who have shown bad behavior on the Hong Kong issue, and on their closest relatives. We have also cancelled visa-free treatment for visits by holders of American holders of special diplomatic passports.

US support for Taiwan’s diplomatic alliances “uncompromisingly opposed” by FMPRC

CNS, Beijing, March 27 — (Huang Yuqin reporting)  Countering America signing the negative bill concerning Taiwan, Chinese foreign ministry spokesman Geng Shuang said on a regular press conference on Friday that China strongly urged America to correct its mistake and not to implement that legislation, and not to obstruct any country’s development of ties with China. Otherwise, it would inevitably be met with a resolute Chinese counterattack.

中新社北京3月27日电 (黄钰钦)针对美方签署涉台消极法案,中国外交部发言人耿爽27日在例行记者会上表示,中方强烈敦促美方纠正错误,不得实施该法,不得阻挠各国同中国发展关系。否则,必将遭到中方坚决反击。

A reporter asked, the American president signed the “Taiwan Friendship International Protection and Strengthening Initiative” bill [into legislation]. How does China comment on this?

有记者提问,美国总统签署了“台湾友邦国际保护及加强倡议法案”。中方对此有何评论?

Geng Shuang replied that America’s so-called “Taipei bill” seriously violated the one-China principle and the rules of the Sino-American Three Communiqués, goes against international law and the fundamental standards of international relations, and interfered in domestic Chinese politics. China expressed intense resentment and uncompromising opposition against this.

耿爽回应称,美方所谓“2019年台北法案”严重违反一个中国原则和中美三个联合公报规定,违背国际法和国际关系基本准则,干涉中国内政。中方对此表示强烈不满和坚决反对。

He pointed out that worldwide, 180 countries had established diplomatic relations with China, with America having established diplomatic relations with China on the basis of the one-China policy as early as 41 years ago. The above-mentioned bill demands the obstruction of other countries sovereign countries’ developing normal national relations. This is undisguised hegemonial logic.

他指出,世界上已有180个国家同中国建交,美国自己早在41年前就在一个中国原则基础上同中国建交,上述法案却要求阻挠其他主权国家同中国发展正常国家关系,这是赤裸裸的霸权主义逻辑。

Geng Shuang emphasized that the Taiwan issue concerns China’s sovereignty and territorial integrity, and China’s core interests. China’s government and people determination and volition to defend their core interests is rock-solid. We strongly urge America to correct its mistake and not to implement that legislation, and not to obstruct any country’s development of ties with China. Otherwise, it would inevitably be met with a resolute Chinese counterattack. (end)

Prague committed betrayal, but it was us, because we were faster

Question: on October 7, the Prague municipal committee2) decided to end the city friendship agreement it had signed with Beijing. Could you please tell us if the Chinese embassy to the Czech Republic has a comment about this?

问:10月7日,布拉格市委会决定终止布拉格市同北京市签署的友城协议。请问中国驻捷克大使馆对此有何评论?

Answer: We have taken note of Prague’s municipal committee’s decision to unilaterally end the city friendship agreement it had signed with Beijing and to pass this on to the the city assembly for consideration. This kind of behavior can even be called treachery, desctruction of Sino-Czech relations and of the atmosphere of the two countries’ local exchange and cooperation. Beijing city has already filed solemn protest to Prague.

答:我们注意到,布拉格市委会日前决定单方面终止该市同北京市签署的友城协议并提交市议会审议。这种行为可谓背信弃义,破坏中捷关系和两国地方交流合作氛围。北京市已就此向布拉格市提出严正抗议。

Concerning this, I would like to emphasize that the one-China principle is a matter of Chinese sovereignty and territorial integrity, touches upon China’s core interests, is the foundation and a prerequisite for all of China’s external exchange and cooperation, and also an accepted international relations’ norm and the international community’s general consensus. The Czech government has consistently supported the one-China principle. China wants to continue the work with the Czech government and all walks of life, for the promotion of exchange and cooperation on all levels between China and the Czech Republic, including the strengthening of the two countries’ local friendly exchange and cooperation.

在此我要强调,一个中国原则事关中国主权和领土完整,涉及中方核心利益,是中方开展一切对外交流合作的基础和前提,也是公认的国际关系准则和国际社会普遍共识。捷克政府一贯坚持一个中国原则。中方愿同捷克政府和社会各界一道,持续推进中捷各层级各领域交流合作,包括加强两国地方友好交流合作。

We urge the Prague municipal authorities to correct their course soon, in tune with the great trend of the era and the advancing tide of history, and to get back onto the correct track of promoting the development of bilateral relations. Otherwise, their own interests will be harmed in the end.

我们敦促布拉格市政当局早日改弦更张,顺应时代发展大势和历史进步潮流,回到促进双方关系发展的正确轨道上来,否则最终损害的将是他们自己的利益。

Guanchazhe published the above Q and A on Wednesday.

But according to Beijing News (新京报), a paper from Beijing, republished here by sina.com on Thursday, it was Beijing’s foreign affair’s office (waiban) that took the decision.

Ever since November 2018, the new Prague authorities’ main officials and others, in disregard of accepted international relations’ norm and the international community’s general consensus, despite China’s solemn position and strong opposition, has again and again taken wrong measures and made improper remarks concerning Taiwan, Tibet and other Chinese core interests.

2018年11月以来,捷克布拉格市新一届市政当局主要官员等人,无视国际关系基本准则和国际社会共识,不顾中方严正立场和强烈反对,屡屡在台湾、涉藏等涉及中方核心利益的重大问题上采取错误行动并发表不当言论。

According to Beijing News, Beijing city’s waiban published its statement on October 9, suggesting that it was Beijing that ended the sister partnership.

We hope that the related personnel2) will soon become aware of the mistake and remove the negative effects by practical actions.

希望布拉格市有关人员早日认识错误,以实际行动消除负面影响。

The paper also notes that the two cities had signed the agreement in March 2016. China Radio International quoted then Prague mayor, Adriana Krnacova, as referring to the partnership as a big opportunity to make educational exchanges, for students to travel back and forth and learn from each other.

According to the South China Morning Post, Prague’s city council had voted to end the agreement after current mayor Zdenek Hrib’s unsuccessful efforts to get Beijing to remove a “one China” pledge from the agreement.

Hrib had never been in Beijing’s good books. Probably, the bid to remove the “one-China” clause from the agreement, and a visit to Taiwan, including a meeting with the country’s president Tsai Ing-wen, were major acts of wrong measures and improper remarks by that piece of personnel from Prague.

Either way, a sinologist from Prague, commenting on Radio Prague International on Thursday, didn’t come across as terribly worried about the consequences, while foreign minister Tomáš Petříček was quoted as saying that said threats had no place in diplomacy.

Under the American machinations, the South China Sea issue has heated up somewhat. American defense secretary Mattis said on May 29 that America would continue to unfold “freedom of navigation activities”, and that the American navy would also take other action.

However, when you read Cayetano’s complete talk carefully, you find that his and Duterte’s attitude are not that extreme.

The South China Sea’s serving as America’s strategic game point can’t be cooled down in the short term. In the future, its continuous heating up will probably occur with a rising frequency. China needs to prepare well psychologically and make tactical arrangements, with the goal of dealing with America in an orderly and methodical way in the South China Sea.

南海作为中美的战略博弈点很难在短时间内冷却下来,它在今后进一步升温看来是高概率趋势。中国必须对此做好充分的心理准备和策略安排,与美在南海有条不紊地长期周旋。

China needs, first of all, to stabilize relations with the claimant countries, especially Vietnam and the Philippines and so on, it needs to continue control of divisions with these countries, avoid the eruption of sharp conflict with any of these countries, [unable to read]. In this way, America’s and its overseas allies excuses for meddling can be greatly reduced, and it will help to let them understand that giving cause to quarrels and manufacturing tense situations are not welcomed.

中国首先需要稳定好与南海声索国,尤其是与越南、菲律宾等的关系,继续管控好同这些国家的分歧,争取不出现同某一个声索国的尖锐冲突,维系发展作为这一地区主题的局面。这样可以大幅减少美国及其南海域外盟友在这里开展干预行动的借口,也会让它们在南海通过搬弄是非制造紧张局势不受欢迎。

Secondly, China must maintain a bottomline concept, strengthen its ability to serve powerful responses, should extreme US intervention in the South China Sea occur. Apart from the deployment of defensive weaponry on the Spratly islands and reefs, China also needs to build a powerful deensive system that includess naval mobile forces and land-based ans air-borne forces, making sure that, if by any chance, the situation in the South China Sea heatens, we are able to meet the situation head-on and fight back at any level of challenge, and any deck of cards.

第二,中国必须保持底线思维,加强对美国一旦在南海采取极端干预进行强有力反制行动的实力建设。除了在南沙岛礁上部署防御性武器,中国还需构建包括海军移动力量和陆基、空基力量组成的强大威慑系统,确保在万一南海局势升级时我方能够迎头回击任何级别的挑战及摊牌。

Thirdly, with ample strength serving as a backup, China will confidently deal with routine military provocations from America, with the principle of each to their own. American declarations of freedom of navigation in the South China Sea don’t touch China; it goes without saying that navigation is free in South China Sea regular territorial waters, and the psychological pressure America can create with this method is decreasing, and its significance diluted. Time in the South China Sea is measured in Chinese and local time, not in American time.

第三,有充足的实力做后盾,中国要自信地与美国一般性军事挑衅耐心周旋,原则应当是它搞它的,我搞我的。美国在南海宣示航行自由奈何不了中国,南海正常水域的航行本来就是自由的,美方这样做所能施加的心理压力一直在递减,其意义不断被冲淡。南海上记录这个时代的钟表使用的一定是中国和当地时间,而决不会是美国时间。

Sovereignty issues concerning the islands and reefs in the South China sea, and maritime rights and interests, are also a testing point for China’s strategic-opportunity development. China must balance these two issues well, and maintain China’s territorial position, and also, it must avoid taking military measures to achieve this position.

南海存在岛礁主权和海洋权益之争,这里同时是中国发展战略机遇期的一个考验点。中国一定要做好这两个问题的平衡,即坚持中国的领土主张,也决不为实现这一主张采取军事手段。

To solve disputes through talks has long been our stable approach. China must strenghten communication with the claimant countries on the South China Sea sovereignty issue, shape mutual understanding, make all sides feel at ease, make regional countries’ development cooperation build on foundations of emerging and solidifying strategic mutual trust. To this end, it is important to implement the “Declaration on the Conduct of Parties in the South China Sea”, to build consensus on standards of negotiations.

通过谈判解决纷争早已是我们的稳定态度,中国要就此与南海主权声索国家加强沟通,形成默契,让各方都安心,使得域内国家的发展合作建立在不断形成并且巩固的战略互信基础之上,为此落实《南海各方行为宣言》,就南海行为准则谈判构建共识都非常重要。

Obviously, navigation in the South China Sea is free, but the South China Sea isn’t a place for countries outside the area to wave about and issue orders, and to show off their military strength. The South China Sea is an important international thoroughfare, but also China’s gate. This means that to China, it needs to be all the more unimpeded. China won’t allow any outisde power to build hostile screenwalls against it here, we have sufficient strength and resolve to persevere until they abandon their harmful attempts against us.

显而易见,南海航行是自由的,但南海不是域外国家指手画脚、耀武扬威的地方。南海是国际大通道,但它同时是中国的家门口,这意味着它对中国来说更必须是畅通的。中国不会允许任何域外力量在这里构建针对中国的敌对性屏障,我们有足够的实力和坚定的意志与任何那样的企图坚决博弈下去,直到它们放弃针对我们的不良企图。

China’s “Core Interests” are becoming peripheral

With the national security law, it has become even clearer that the term refers to what Chinese leaders see as three sacrosanct rights of the nation,

the New York Times (NYT) noted in July 2015:

maintaining the political system, with unquestioned rule by the Communist Party; defending sovereignty claims and territorial integrity; and economic development.

That represented “a considerable expansion” of China’s previous “core-interest” concept, which had been believed to refer to Taiwan, Tibet, and Xinjiang.

The NYT article described a history of expanding the concept. Earlier this year, probably under the flag of “economic-development core interest”, it has reached South Asia.

Arguing that most of India’s “peripheral countries are also Beijing’s neighbors”, a “Global Times” author wrote on March 21 this year that

When an increasing number of Chinese companies get established in these countries, it is inevitable that Beijing will boost defense collaboration with them to protect not only China’s, but also the region’s interest.

If India tried to “balance China” in the region, rather than being part of the pursuit of China and regional countries for common development, grave consequences would be in the pipeline:

If such tendencies in India continue, China will have to fight back, because its core interests will have been violated. This is not what we hope for, but the ball is in India’s court.

In short: with the core interest of economic development comes defense collaboration abroad.

The core is becoming peripheral.
